1. Acceptance of Terms

By accessing or using whyhireclay.ai ("the Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Site.

These Terms apply to all visitors, users, and others who access the Site, regardless of location.

2. Description of Service

whyhireclay.ai is a personal portfolio and narrative website operated by Clay Cash. It documents a one-week journey of building projects with Claude Code, and serves as a professional showcase and job application.

The Site includes:

• • Narrative content about Clay Cash's professional journey and projects
• • Links to external websites (cdiscovery.io, LinkedIn, YouTube)
• • An AI-powered chat feature ("ClayBot") that answers questions about Clay Cash, his work, and the creative process
• • Contact information for reaching Clay Cash directly

3. ClayBot AI Chat Feature

The Site includes an AI-powered chat assistant called "ClayBot." By using ClayBot, you acknowledge and agree to the following:

• • AI-generated content: ClayBot's responses are generated by Anthropic's Claude AI model. Responses may not always be accurate, complete, or up to date. They do not constitute professional advice of any kind (legal, financial, career, or otherwise).
• • No data retention: Chat messages are processed in real-time and are not stored, logged, or retained by the Site. Messages exist only in your browser session and are permanently lost when you close or refresh the page.
• • Third-party processing: Your chat messages are sent to Anthropic's API for processing. This is governed by Anthropic's privacy policy and terms of use. API inputs and outputs are not used by Anthropic to train their models.
• • Rate limits: To prevent abuse, chat usage is rate-limited to 10 messages per minute, with a maximum message length of 2,000 characters and a conversation limit of 30 messages.
• • No sensitive information: Do not share personally identifiable information, passwords, financial details, or other sensitive data through the chat. While we do not store messages, they are transmitted to a third-party API for processing.

4. No Data Storage

We do not store or save any personal information about visitors to this Site.

The only information that reaches Clay Cash is information you explicitly and voluntarily choose to send — for example, by clicking the email contact link and sending an email from your own email client.

5. Acceptable Use

You agree not to use the Site to:

• • Attempt to gain unauthorized access to any part of the Site, its servers, or connected systems

• • Abuse the ClayBot chat feature, including by submitting harmful, abusive, or illegal content, or by attempting to circumvent rate limits
• • Attempt to extract, scrape, or harvest data from the Site in an automated manner for commercial purposes
• • Impersonate Clay Cash or misrepresent your relationship with the Site

We reserve the right to restrict or terminate access to the Site for any user who violates these terms.

6. Intellectual Property

All content on the Site — including text, design, code, graphics, and logos — is the property of Clay Cash unless otherwise noted.

The Site was built using open-source tools (Tailwind CSS) and third-party services (Vercel, Anthropic, Google Fonts), each of which retains ownership of their respective intellectual property.

You may share links to the Site freely. You may not reproduce, distribute, or create derivative works from the Site's content without prior written permission.

7. Disclaimers

THE SITE AND ALL CONTENT, FEATURES, AND SERVICES (INCLUDING CLAYBOT) ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We disclaim all warranties, including but not limited to:

• • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• • Any warranty that the Site will be uninterrupted, secure, or error-free
• • Any warranty regarding the accuracy or reliability of AI-generated content from ClayBot

ClayBot is an AI assistant. Its responses should not be relied upon as professional advice. Always verify important information independently.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLAY CASH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE.

IN NO EVENT SHALL THE TOTAL LIABILITY OF CLAY CASH FOR ALL CLAIMS RELATED TO THE SITE EXCEED ONE HUNDRED US DOLLARS (USD $100.00). Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, liability is limited to the fullest extent permitted by law.

You agree to indemnify and hold harmless Clay Cash from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

The Site uses the following third-party services:

These services are governed by their own terms of service and privacy policies. We are not responsible for the practices of third-party service providers.

The Site may contain links to external websites. We are not responsible for the content, privacy practices, or terms of any third-party websites.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Site shall be resolved in the state or federal courts located in Wake County, North Carolina, and you consent to the personal jurisdiction of such courts. Nothing in these Terms shall limit your rights under mandatory consumer protection laws in your jurisdiction.

12. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Site after any changes indicates your acceptance of the updated Terms. If we make material changes, we will make reasonable efforts to notify visitors.
